These Terms of Service ("Terms") are an agreement between you and [YOUR BUSINESS NAME] ("ExamZilla," "we," "us" or "our"), which operates the ExamZilla website at examzillasee.systeme.io and its course, practice questions, videos, tutoring and related services (together, the "Service"). By creating an account, making a purchase, or using the Service, you agree to these Terms; if you do not agree, do not use the Service. You must be at least 18 years old to buy or use the Service. ExamZilla is an independent exam-preparation course and is not affiliated with, endorsed by, or connected to the Internal Revenue Service (IRS) or PSI Services, LLC. The Service is for educational purposes only. Nothing in the Service, including lessons, videos, practice questions, emails or tutoring sessions, is tax, legal, accounting or financial advice, and no professional relationship is created between you and ExamZilla or any of its instructors, including Michael Jones, EA, CFP®; for advice about your own situation, consult a licensed professional. Tax law changes often, and while we work to keep the material accurate and current, we do not guarantee that the content is complete, error-free or up to date. We make no promise, guarantee or warranty that you will pass any part of the Special Enrollment Examination, obtain enrollment as an enrolled agent, or achieve any score, job, income or other result; your results depend on your own study and effort. Monthly access costs $64.99 per month and renews automatically every month on the same date you first subscribed, and your payment method will be charged each month until you cancel. You may cancel at any time [describe how, e.g. from your account page or by contacting us through examzillasee.systeme.io/contact]; when you cancel, you will not be charged again, and you keep access until the end of the month you have already paid for, after which access ends. Lifetime access is a one-time payment of $349.99 and gives you access to the course for as long as ExamZilla offers it; "lifetime" refers to the life of the course and the Service, not the life of the purchaser, and if we ever discontinue the course we will try to give members reasonable advance notice. Lifetime access includes future updates for new tax years. One-on-one tutoring is billed at $75 per hour, is held by video call, and is separate from the course plans; to reschedule or cancel a session you must give at least [24] hours' notice, a session missed without that notice is forfeited, and if we must cancel a session we will reschedule it or refund that session. Tutoring sessions are exam preparation only and will not cover your personal tax, legal or financial situation. All purchases are final and non-refundable, including monthly payments, lifetime access and tutoring, and there are no refunds or credits for partial months, unused time, or content you did not use, except as stated above for sessions we cancel or where a refund is required by law. We may change our prices at any time, but any price change for an existing monthly subscription will take effect only after we give you notice and before your next billing date. Payments are processed by our payment providers, and we do not store your full card number. Your account is for one person only. You may not share your login, give or sell access to anyone else, or let others use your account, and you are responsible for keeping your password secure and for all activity on your account. We may monitor for signs of account sharing, such as logins from many devices or locations at once. All content in the Service, including lesson text, outlines, practice questions, explanations, videos, images, the ExamZilla name, logo and mascot, is owned by ExamZilla or its licensors and is protected by copyright and other laws. We give you a limited, personal, non-transferable, non-exclusive, revocable license to view the content on the website for your own personal exam preparation, and nothing more. You may not copy, paste, download, screen-record, scrape, reproduce, distribute, publish, sell, rent or share any content from the Service; you may not save videos or text to share elsewhere; you may not use bots or automated tools to access the Service; you may not upload or feed the content into artificial intelligence tools or use it to train them; you may not use the content to build or teach a competing course; and you may not post, share or ask for actual questions from the Special Enrollment Examination anywhere in the Service, since candidates agree to keep that exam content confidential. If you break these Terms, we may suspend your account while we investigate and may terminate your membership immediately without notice and without a refund, and we may also pursue any other remedies available to us. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise the Service will be uninterrupted or free of errors. To the fullest extent allowed by law, ExamZilla and its owners, instructors and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost data, exam fees, or failed exam attempts, and our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim. You agree to indemnify and hold harmless ExamZilla and its owners, instructors and contractors from any claims, losses and costs, including reasonable attorneys' fees, arising from your misuse of the Service or your breach of these Terms. Your use of the Service is also governed by our Privacy Policy. We may update these Terms from time to time; if we make material changes, we will post the new Terms on this page with a new effective date and, for active members, notify you by email, and your continued use of the Service after the changes take effect means you accept them. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and any dispute relating to these Terms or the Service will be brought only in the state or federal courts located in United States of America, and you consent to their jurisdiction. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and ExamZilla about the Service.
